We've reviewed Horgan's petition to dismiss the recall and drafted responses for submission to the judge (to be appointed). Look on the recallhorgan.com website to see his petition; does it seem odd that there's no challenge to the substance of the recall, just to formats and such?
ReplyDeleteShow your support, along with other Fayette County citizens this Thursday, Aug 13th at 7:00 PM in the Commission's regular meeting at the Stonewall Complex (where you buy your auto tags). Pick up a 'Recall Horgan' button & bumper sticker from a volunteer.
ReplyDeleteAdd greater emphasis by expressing your opinion to the commissioners, as many other voters are doing; everyone is afforded up to five minutes during Public Comment. You don't have to be an orator, just tell them how you feel about trust, leadership, and example.
Three speakers against Horgan at last night's commission meeting- he has absolutely no shame.

ReplyDeleteThe judge's decision is a setback, no doubt. What is the new strategy? How do we get Mr. Horgan to accept that holding an elective office is a privilege granted to him by voters? It's a free country; if he wants to smoke pot and evade the law, that's his choice. But if he understood his obligation to the voters, he would know he's violating a tremendous trust.
ReplyDeleteThe judge found an insufficient relation between Horgan's misconduct and the administration of his office & its adverse effects on the public. Therefore, the county cannot issue a recall petition to the Committee. After reviewing the judge's published order, we'll determine our next action.
ReplyDeleteIt's funny how people keep saying things like "..save us the publicity.." and "...this is an embarrassment to the community..." It is how THIS committee is behaving that is truly shameful. This committee and all the people ranting and raving about Mr. Horgan's recall are acting like vindictive children. What ever happened to the FAMILY values we so cherish and why don't we show SUPPORT for Mr. Horgan?!? Yes, he made a mistake. WHO HASN'T?!?!? I challenge everyone on this committee to shed light on all of their "mistakes" before they throw rocks in their glass houses. I'm sure they've done much worse (not to mention what they're doing RIGHT HERE!).
ReplyDeleteRobert Horgan has proven to be a fantastic Commissioner and, for once, provides a viewpoint outside of the good ole boys club.
As a longtime resident in Fayette County, I'm ashamed at the behavior of this committee. I'm also proud of the people who have stood up to these bullies and have shown support for Mr. Horgan.
I and the vast majority of Fayette voters I've come in contact with don't want to toss Horgan in jail for a year for his misdemeanor drug charge.
ReplyDeleteBut we also view his deliberate acts to obtain, possess, use (and simultaneously drive), lie to a sheriff's deputy, and seek personal favor at the expense of the public's right to know, as more than a single 'mistake'. As a father, husband, business owner, and senior elected official, he should clearly know better. That he doesn't is clear evidence that he lacks the requisite judgment & leadership to continue serving.
Again, don't jail him for a year, but there is at least one other Fayette citizen with judgment far superior to that demonstrated by Horgan. Mr Horgan, step aside.
It is too bad that some are ashamed of the work of this committee. It is like the cry in Clinton days - it doesn't matter what his character is if he votes right. Sorry, character is everything, EVERYTHING. Bad character will always lead to bad decisions and leadership. Mr. Horgan needs to resign or we as citizens need to do what it takes to oust him. This committee is acting very responsibly. We are accountable for our mistakes. Yes, none of us is perfect and we each must be accountable for our mistakes. We can forgive Horgan but we cannot allow him to continue to lead us without selling out our integrity with him.
ReplyDeleteWhat ever happened to innocent until proven guilty? Due process? That seems to have been trampled on in the case.
ReplyDeleteIn my opinion, an effort to recall prior to a conviction...well...that's bad enough. Now it seems the recall effort (or "what it takes to oust him") continues despite a judges ruling in a court of law. Integrety in this matter has long since gone. I guess rulings don't apply to men of "character".
Its time to remove the Recall Robert Horgan website until such time that the appeal is sucessful and a recall can take place.

Scott, thanks for stopping by and posting your thoughts. Here’re some additional facts relative to your comments:
ReplyDelete- At the Aug 28 superior court judicial review, Robert stipulated to his possession of marijuana as stated in the sheriff’s report (which means he agreed that the facts were true or uncontested).
- Based on Horgan’s stipulation, the superior court judge found that Horgan had committed an act of misconduct in office under GA law, and had violated the GA State Code of Ethics.
- The judge further ruled that the relation between Horgan’s misconduct and the administration of his office was insufficient to meet the strict language of the applicable law; obviously, the Committee saw such a relation between Horgan’s extremely poor judgment & example and his elected office.
- The recall process is one legal means of removing an elected official from office, but not the only legal means. Because one judge ruled the July 14th application insufficient does not preclude voters from exercising other legal avenues.
- The GA State Constitution states “All government, of right, originates with the people, is founded upon their will only, and is instituted solely for the good of the whole. Public officers are the trustees and servants of the people and are at all times amenable to them.” (Article 1, Section 2, para. 1)
- The website remains active to inform voters of the facts and provide a forum for their discussion. Let the people decide if Robert Horgan’s multiple poor judgments, failure to even apologize for them, and negative leadership warrant his remaining in the Post 1 seat.
Mr. Horgan's refusal to resign after arrest for possession and driving while under the influence of a mind-altering and illegal substance (by his own admission per Case 0904859) would be just another criminal report if Mr. Horgan were not an elected leader and role model for his community, state, nation, and the world. Mr. Horgan's question to the arresting officer amounts to attempt at conspiracy, a cowardly act at best. Mr. Horgan did not use bad judgment, he made a decision; he owns it and the responsibility that goes with ownership.

ReplyDeleteA panel of three county attorneys from nearby counties will hear the complaint against Robert Horgan to determine if he violated the Fayette County Ethics Ordinance. If found in violation he faces a fine up to $1,000 and censure.

ReplyDeletePause, take a deep breath, and swap your emotional outbursts for facts that are documented throughout the site. Then you'll see:
- Horgan's stipulation to a superior court judge on August 28th, where he agreed to unlawful possession of drugs.
- Judge Baldwin's certified ruling that Horgan had committed misconduct in office and had violated the GA State of Ethics for Government Service.
- Horgan himself publicly spoke to reporters about his behavior ("I made a mistake").
- Horgan himself addressed the May 28 Commission meeting of the incident; why would he publicly humiliate himself for something he didn't do?
Sep 28,2009: In his ethics violation hearing, Horgan again agrees to the facts in the sheriff's report.
